A man who was charged with causing a disturbance at Fort MacMurray International Airport on December 19, 2014 has been sentenced. Luke Penner was frustrated with security at the airport and made some comments that were taken as serious threats, forcing the airport to shut down operations for a period of time. Penner was given a $2,500 fine, he must be on probation for 6 months, and he must perform 80 hours of community service according to the judge. Instead of going to trial Penner entered a guilty plea to a single count of causing a disturbance and the Provincial Court sentenced him for the charge. In the agreed upon statement of facts Luke Penner was involved in boarding a flight from Air Canada when an agent at the airport overheard Penner state to his girlfriend on the phone that airport staff considered everything to be a bomb, which caused the agent to become suspicious.

When Fort MacMurray International Airport staff asked Penner to leave his seat on the plane the man asked staff whether there was a bomb on the plane and started using profanities at the staff, causing a disturbance among the passengers. Because the operations at the airport were shut down for roughly two hours due to the security threat many people were inconvenienced and a lot of money was wasted..Provincial Court Justice James Jacques estimated that the incident probably costs hundreds of thousands of dollars, and around 300 people were severely inconvenienced because they had to wait outside the facility while the airport was searched by the security staff. Penner told the judge “I let my emotions get the best of me, and really messed things up for a lot of people.”

CUPE Wants Clarification About Immigrant Workers and Working Conditions at Fort MacMurray International Airport

CUPE, the union that represents Fort MacMurray International Airport workers, has made accusations that the airport administration is either recruiting temporary foreign workers or else they are underpaying migrant workers. The union organization has demanded to know exactly what the working conditions are for the workers who replaced the hired custodial staff. CUPE has said that airport staff have reported that many of the new workers who replaced the full time custodial staff are using foreign passports as identification, including Philippine passports. Airport staff have stated that some of these new workers are custodial workers. CUPE is concerned that the move from the previous custodial staff to outsourced workers has replaced Canadian citizens with foreign immigrant workers. CUPE’s Alberta Division secretary treasurer Glynnis Lieb said “I would be very surprised if that wasn’t the case. What the airport authority has said is they will save money by moving to these private companies for custodial and now security staff.”

Even if Fort MacMurray International Airport is using foreign immigrant workers this does not mean that any laws have been broken. When Bill’s Cleaning took over custodial duties at the facility CUPE protested, because the company has a history of using temporary foreign workers and paying very low wages. Lieb explained “Regardless of the nationality, are people being paid fairly? Are they getting the benefits they deserve to get in Canada? What is happening?. We want to protect our members and the thought of our members losing jobs because they cost too much is a concern to us, and we want to make sure no one is being exploited to save money.” Now that the security staff at the airport will also be outsourced this just heightens the concerns that workers and the union has.

A bomb scare t Fort MacMurray International Airport late last year has resulted in a guilty plea. On December 19 of 2014 Luke Penner was in the airport walking towards Gate 1 and talking on his cell phone when an airport attendant overheard him say “I could have a bomb in my shoes, I could have a bomb in my belt, everything is a bomb to these people.” The airport was evacuated as a precaution, and Penner recently entered a guilty plea to one count of causing a disturbance. According to crown prosecutor Dominique Mathurin defendant Penner also stated that he could plant a fake bomb in someone’s luggage in order to get them in trouble. After sitting down on the plane Luke was asked to depart the plane with the attendant, to which Penner replied “What’s the hold up, is there a bomb in the plane?”

When the Fort MacMurray International Airport was emptied because of the bomb scare over 300 people were evacuated and inconvenienced while the airport was shut down. For the next two hours numerous security checks were performed to ensure that there was no bomb anywhere in the facility. Four planes were delayed as a result of the bomb scare. In court Justice James Jacques stated “It had huge consequences for hundreds, if not thousands, of people.” According to the defense attorney in the case Luke Penner was highly intoxicated at the time of the incident. A sentencing hearing for Penner is scheduled for August 26, 2015, so that a pre sentencing report can be completed.

TFWs Will Not be Used By Contractor at Fort MacMurray International Airport After Layoffs

The possible use of TFWs at Fort MacMurray International Airport to replace laid off custodial staff has many people upset. Protests at the airport have been held and a lot of criticism has been given, some of it from people in high places and important positions. Initially Robert Clements was unresponsive to the concerns of the community and labor groups but that is starting to change. First Clements held firm and made comments that stopped short of guaranteeing that the staff at the airport would not be replaced with TFWs. In fact the CEO of the facility even told others that he would not stop Bill’s Cleaning Service from using TFWs if these were needed, The weeks of very visible protest and criticism have caused Clements to change his stance some.

During a recent press conference Fort MacMurray International Airport CEO Scott Clements provided some assurance that TFWs will not be used to fulfill the contract between the airport and Bill’s Cleaning Service. Clement said that the contract for the custodial services will include a pledge that no TFWs will be used, only Canadians. According to AFL president Gil McGowan the pledge is not enough. McGowan told the media “I’m afraid that six months to a year from now, when no one is looking and the scrutiny has passed, they’ll see TFWs filling these positions. Even if no TFWs end up at the work site, the fact remains that with this plan, Mr. Clements is turning good jobs into bad jobs at a time when the people of Fort MacMurray need as many good jobs as they can get.”

Pay Cuts Accepted By CUPE Workers at Fort MacMurray International Airport Before Layoffs Announced

CUPE workers at Fort MacMurray International Airport had accepted pay cuts before the upcoming layoffs of custodial staff were announced. According to the CUPE Local 1505, the union that represents custodial workers at the airport. Pay cuts were accepted by the union and it’s members in order to help bring operational expenses under control after the new $258 million terminal. The layoffs are highly controversial in the area, and the company chosen for the new contract to replace the laid off workers is Bill’s General Cleaning. This company has been criticized in the past for their use of temporary foreign workers and many fear that TFWs will be used in replacing the custodial workers at the airport. These concerns have led to protests and vocal complaints, both against the layoffs themselves and against the facility.

If CUPE workers have already agreed to pay cuts previously then Fort MacMurray International Airport should be respectful of this during the negotiations. According to one worker, Darlene Christopher, she took a 10% cut in pay soon after she started her employment with the airport facility. When discussing the situation Christopher said “I actually quit my other job because I was promised so much security and benefits at this job, I have to depend on my kids to try to help me right now. I shouldn’t have to, I should have my job to help me take care of myself.” According to Gil McGowan, president of Alberta Federation of Labour “This is absolutely no way to pay back workers for such intense loyalty. We will have no choice but to implement a very aggressive campaign with implications for both the airport and the municipality. That could include making this an election issue in the next municipal election. We won’t forget this.”

Union Asks Brian Jean to Stop Layoffs at Fort MacMurray International Airport

CUPE, a union that represents numerous airport workers at Fort MacMurray International Airport, is asking Brian Jean to stop the proposed layoffs at the airport which are scheduled to take place in May. The layoffs will cost 24 full time employees and 1 part time employee their positions, which pay $28 an hour on average. The union is asking for intervention from Brian Jean because of previous comments he had made in the past which were critical of the temporary foreign worker program. Merle Roberts, the president of CUPE Alberta, released a statement which said “When he was in the House of Commons, Mr. Jean made very clear statements about the TFW program. It’s time he intervened in the Fort McMurray situation.”

In the past Brian Jean has been critical about the temporary foreign worker program because some Canadian citizens have been replaced with foreign workers. Past comments by Jean lead the union to believe that he may intervene in the situation at Fort MacMurray International Airport. Past comments by Jean which have been critical of the TFW program include “I have heard from union and non-union members throughout my constituency that they clearly want some changes to the temporary foreign worker program. We are here for Canadians, and Canadians should have first crack at any job they want, no matter what part of the country they are from.” Jean also previously said “We have no toleration for those people who abuse the system and we have no tolerance for those who abuse their workers.” Don Scott discussed the staffing changes and said “I have been told by senior leadership at the airport there was no TFWs involved in the contract.”
