The Alberta Court of Appeal has struck down the law that allows the province to suspend the licences of people charged with impaired driving who are waiting to go to trial.
In a split decision, Alberta’s highest court ruled having an operator’s licence is protected by the Canadian Charter of Rights and Freedoms.
While the law has been declared unconstitutional, it will remain in place for one year until the province can change it.
Since the law came into effect in 2012, drivers charged with drunk driving lose their licences before their cases are resolved in court.
